ACLU President Strossen on religion, drugs, guns and impeaching George Bush

There are few organizations in the United States that elicit a stronger emotional response than the American Civil Liberties Union, whose stated goal is “to defend and preserve the individual rights and liberties guaranteed to every person in this country by the Constitution and laws of the United States”. Those people include gays, Nazis, women seeking abortion, gun owners, SPAM mailers and drug users. People who are often not popular with various segments of the public. The ACLU’s philosophy is not that it agrees or disagrees with any of these people and the choices that they make, but that they have personal liberties that must not be trampled upon.

In Wikinews reporter David Shankbone’s interview with the President of the ACLU, Nadine Strossen, he wanted to cover some basic ground on the ACLU’s beliefs. Perhaps the area where they are most misunderstood or have their beliefs most misrepresented is their feelings about religion in the public sphere. The ACLU categorically does not want to see religion disappear from schools or in the public forum; but they do not want to see government advocacy of any particular religion. Thus, former Alabama Chief Justice Roy Moore’s placement of a ten ton monument to the Ten Commandments outside the courthouse is strenuously opposed; but “Lone Ranger of the Manger” Rita Warren’s placement of nativity scenes in public parks is vigorously defended. In the interview, Strossen talks about how certain politicians and televangelists purposefully misstate the law and the ACLU’s work in order to raise funds for their campaigns.

David Shankbone’s discussion with Strossen touches upon many of the ACLU’s hot button issues: religion, Second Amendment rights, drug liberalization, “partial-birth abortion” and whether or not George W. Bush should be impeached. It may surprise the reader that many ideas people have about the most visible of America’s civil libertarian organizations are not factually correct and that the ACLU often works closely with many of the organizations people think despise its existence.

Dealing With Shoulder Arthritis

Q: My doctor has told me that the pain in my shoulder is due to arthritis. Is there anything that can be done about it?

A: Has throwing the ball with the kids become a big pain in the shoulder? As we get older our joints may deteriorate, with loss of the smooth cartilage coating of the bones in the shoulder joint, a process known as arthritis. It can be caused by a variety of factors, but the most common process in the shoulder is degenerative joint disease (DJD). The shoulder is made up of two distinct joints, the large ball-and-socket Gleno-Humeral Joint (GH), where the arm meets socket of the shoulder blade, and the much smaller Acromio-Clavicular (AC) Joint, where the top part of the shoulder blade (the acromion) meets the collar bone (clavicle). Either or both joints can become damaged and painful, and X-rays will be used to detect whether arthritis is present.

Once the diagnosis is made, treatment generally starts with oral medications to reduce the pain and inflammation within the joints. This generally starts with medicines like Tylenol or anti-inflammatories known as NSAIDs, either over-the-counter or by prescription. Sometimes it is necessary to use a short course of stronger anti-inflammatory medicines known as steroids, such as prednisone, usually given in a precise regimen that is tapered quickly. Some patients will benefit from Physical Therapy treatments, which can help by improving the range of motion and strength in the shoulder.

If this approach is not successful, a patient may need to have a steroid injection in the shoulder, which can be effective by placing the anti-inflammatory material directly into the painful area. The effect may not last long, but the injection can help to confirm that the arthritic area is actually causing the shoulder pain. On the other hand, some shots will lead to long-term pain relief. We have some patients who come to the office every six months for a steroid shot and function well between visits.

If this approach is not working, surgery may be needed. An MRI is often obtained to rule out other shoulder damage, such as tendonitis or a rotator cuff tear, and it is also useful to gauge the full extent of the arthritis.

If the upper (AC) joint is the primary source of pain, and conservative measures have failed, relatively simple surgery can usually solve the problem. The AC joint pain seems to come from the deformed ends of the bones which rub together once the cartilage coating has worn away. We can remove the ends of the bones and the scar that fills the space will gradually become comfortable. At first, this was done as an open procedure, but now it is done routinely through small stab wounds using a fiber-optic tool known as an arthroscope.

When the ball-and-socket shoulder joint (GH) is arthritic and requires surgery, things get more complicated. As an open procedure, requiring an incision that is about six inches long, the damaged joint surfaces can be replaced by an artificial joint made of plastic and metal. This procedure has evolved over the years and is now very reliable. The recovery period will last six to twelve months and will require Physical Therapy. When a patient has fully recovered, the shoulder strength and function should be reasonably good, but patients almost always report that their pain is gone. In fact, some of our happiest patients are those who put up with severe shoulder arthritis for years and after getting a Total Shoulder Replacement could finally get a good night’s sleep.

We have a dilemma when a patient has severe ball-and-socket shoulder arthritis along with a large rotator cuff tear. The soft tissue envelope of tendons around the shoulder is known as the Rotator Cuff, and if it is massively torn and unrepairable, a conventional shoulder replacement may not work well, because the shoulder will be weak and unstable and the components will tend to become loose and painful. Fortunately, an ingenious solution has been developed to deal with this situation. A Reverse Total Shoulder Arthroplasty is a plastic and metal device which replaces the socket with a ball and replaces the ball with a socket, allowing most patients to regain overhead motion without an intact rotator cuff. The surgery is somewhat more complicated and there are more potential complications, but for certain patients, it is just what the doctor ordered.

What to do: If you have shoulder pain that lasts more than a few weeks, try gentle stretching and over-the-counter medicines such as Tylenol or NSAIDs. If you cannot get relief, make plans to see your doctor. These days, most shoulder pain can be resolved. With any luck you will be able to get back to throwing in the backyard in time for spring training.

Australian researchers confirm stress makes you sick

Australian researchers say they have scientifically proven that stress causes sickness. The Garvan Institute in Sydney has discovered that a hormone, known as neuropeptide Y (NPY) is released into the body during times of stress. Their findings show the hormone can stop the immune system from functioning properly.

“Neuropeptide Y is one of those hormones that gets unregulated or released from neurones when stressful situations occur…it’s known for example that it regulates blood pressure and heart rates so your heart rate goes up but it hasn’t been known that it actually can affect immune cells as well,” said Professor Herbert Herzog, one of the researchers.

Herzog feels it is good to finally have proof of something people have suspected for so long.

“Now we have proven without doubt that there is a direct link and that stress can weaken the immune system and that makes you more vulnerable when you for example have a cold or flu and even in the more serious situations such as cancer can be enhanced in these situations,” said Herzog.

The Garvan Institute study centres on two key events that enable the human body to recognise foreign substances and control invaders. When our body encounters a pathogen (bacteria and viruses), the immune cells retain and interrogate suspects. Their activation is made possible by NPY. These cells then return to the lymph nodes, which are found all over the body, with information about the foreign invaders. The lymph nodes are where decisions about defence are made.

“Most of us expect to come down with a cold or other illness when we are under pressure, but until now we have mostly had circumstantial evidence for a link between the brain and the immune system,” said lead Garvan researcher, associate Professor Fabienne Mackay. “During periods of stress, nerves release a lot of NPY and it gets into the bloodstream, where it directly impacts on the cells in the immune system that look out for and destroy pathogens (bacteria and viruses) in the body.”

In the case of bacteria and viruses, TH1 cells are part of the attack team that is sent out on the ‘search and destroy’ mission. But when their job is done they need to be turned ‘off’ and the immune system reset. The same hormone, NPY, that activates the sentry cells now prompts the TH1 cells to slow down and die.

“Under normal conditions, circulating immune cells produce small amounts of NPY, which enables the immune cells on sentry duty and the TH1 immune cells to operate – it’s a yin and yang kind of situation. But too much NPY means that the TH1 attack is prevented despite the foreign invaders being identified – and this is what happens during stress,” added McKay.

The impact of stress on the body has been observed in athletes. Ph. D researcher at the University of Queensland, Luke Spence, together with the Australian Institute of Sport, studied elite and recreational athletes over five months.

They found elite athletes were more susceptible to respiratory diseases under stress.

“A lot of elite athletes put themselves through vast amounts of physical stress in their training, but also their emotional, psychological stress of feeling the pressure of Australia on their shoulders, wanting to compete and wanting to do their best,” said Spence.

It’s not just athletes who are prone to stress. Pressures at work and at home may cause emotional and mental stress that can be equally damaging. Almost a third of all work absenteeism in Australia is due to illness, costing employers over $10 billion a year.

“I think it has a huge impact for the work force and also for employers – if their employees are constantly stressed, constantly under pressure, they are more likely to get sick,” Spence said.

Further research could lead to the development of new drugs which may inhibit the action of the neuropeptide Y hormone.

Herzog warns people to minimise stress before it becomes a problem.

“Relaxation methods like yoga will help you to prevent that but there will still be people out there that are not responding to that and treatment by interfering with the system will be important,” he said. “There’s obviously some time until such a treatment will be available but this is something we will definitely work towards.”

The Garvan research will be published in the Journal of Experimental Medicine, Volume 202, No. 11.

Bird Flu found in Africa

The H5N1 Avian Flu virus, also known as Bird Flu, has been found in Nigeria by Italian scientists. Tests done on samples in a laboratory confirm that the strain is the one that can kill people, although no human cases have been reported said the Paris-based United Nations body. This is the first time is has appeared on the continent.

Reports say tests of the virus closely resemble the virus in Asia. The virus has been discovered in poultry flocks in a large Nigerian farm. “It is the first report of the disease in Africa,” the Paris-based World Organization for Animal Health (OIE) said on Wednesday.

“It’s going to be very difficult to mount an eradication campaign,” said Dr. Alex Thiermann, president of the OIE’s international animal health code, from Paris, France. “With what we have today, it is a highly pathogenic H5N1 – the same, or very closely related to the previous ones,” said Thiermann. He also added, “a full genetic analysis of sample viruses is expected to be completed by late Thursday.”

Maria Zampaglione of the Paris-based OIE said “An outbreak has been detected. A local poultry farm keeping 46,000 birds was affected, of which 42,000 were infected and 40,000 of those, died.” The farm is located in Jaji, which is a village in the northern state of Kaduna.

“The farm is located near the Niger Delta, one of the largest over-wintering areas for wild birds in Africa.” said Thiermann.

Quarantine measures on the control and movement of poultry have been taken, and the farm has been disinfected said Nigerian authorities.

“However, it is too early to say how serious the outbreak is and how big its spread could be,” said Ilaria Capua of the Italian bird flu centre in Padua. “We have to be cautious in evaluating the possible implications of these findings.”

In Rome, Samuel Jutzi, a director of the UN’s Food and Agriculture Organization said, “if the situation in Nigeria gets out of control, it will have a devastating impact on the poultry population in the region. It will seriously damage the livelihoods of millions of people and it will increase the exposure of humans to the virus.”

“When you have 46,000 chickens in a house, usually you have some degree of biocontainment…So these (chickens) are not likely to be the ones to first encounter migratory waterfowl,” Thiermann said.

Wildlife circles have been debating on whether or not wild birds are spreading the virus around the globe. Experts believe they are playing a role but most believe poultry movement, poultry products and poultry manure is the main cause of the spreading of the virus.

“But probably not in this case,” said Thiermann. “While it’s too early to blame the wildlife, it’s very likely to be in an area that’s remote enough that it’s not likely to be associated with international trade.”

OIE spokeswoman Zampiglione also said, “Experts had been fearing an African outbreak for months. The conditions there are more likely to lead to contagion from birds to man.”

Australian rules football: 2010 Gippsland Football League round 1 – Wonthaggi v Leongatha

Wonthaggi, Victoria — Wonthaggi defeated Leongatha at home in the opening game of the 2010 Gippsland Football League (officially the Gippsland League, GL) season this past Saturday. The match, unofficially dubbed “the South Gippsland derby”, was played a week prior to the other opening round matches.

The three remaining matches of round one are scheduled to be played next Saturday (April 10). Morwell will host Warragul in Morwell, Drouin will play Maffra in Drouin and Moe will host Traralgon at Yallourn North with Sale having the bye.

The Gippsland Football League is considered one of the “major leagues” controlled by the Victorian Country Football League, the governing body of Australian rules football in regional Victoria, Australia.

At the league’s annual general meeting in December, it changed it’s name from the West Gippsland Latrobe Football League. At the same meeting, Wonthaggi joined the GL after dominating the Alberton Football League during the past decade. The Power made five concecutive Alberton Grand Finals winning three, losing only to Yarram (2007) and Stony Creek (2009).

Wonthaggi Power Football Club is a result of a merger between Wonthaggi Blues, a former Gippsland FL team, and Wonthaggi Rovers, an Alberton FL team. In February, the Gippsland Football League announced that Wonthaggi would be changing their uniforms, because their original one was similar to that of Warragul.

Leongatha finished the 2009 season losing the minor semi final against enventual grand final winners Maffra. Leongatha defeated Drouin in the last Elimination Final under the West Gippsland Latrobe Football League banner.

Wonthggi kicked off their first game in the major league with a opening quarter lead of four and a half goals over rivals Leongatha. The Power’s move from the Alberton League looked to be justified as they went in to cruise mode.

Leongatha slowly clawed back the deficit over the next three quarters but the first quarter result and inaccurate kicking caused them to fall short by one point.

\\r\\n\\r\\nOn September 24, 2007 Treasurer Wayne Swan made amendments to the superannuation Industry Act which gave Self Managed Superannuation Funds (SMSFs) the ability to borrow money that could be used for the purchase of an asset – in this case for the purchase of property. This borrowing is undertaken through what is known as an Installment Warrant. \\r\\n\\r\\nFurther, in 2008 Treasurer Wayne Swan MP along with Minister for Housing Tanya Plibersek MP launched the National Rental Affordability Scheme or NRAS. The NRAS was established to increase the supply of affordable rental properties in Australia and to reduce market rental costs to low & middle income earners and encourage private investment in these types of properties. \\r\\n\\r\\nThere are many specifics that make investing in property through your SMSF an attractive proposition however there are also some potential pitfalls that need to be noted. \\r\\n\\r\\nBefore You Purchase Property Through Your SMSF\\r\\n\\r\\nThere are five essential requirements that must be met before you can purchase property through your SMSF. \\r\\n\\r\\n1.The borrowed funds must be applied towards a single acquirable asset. \\r\\n2.The asset must be one that a SMSF would normally be allowed to acquire under the applicable legislation.\\r\\n3.The acquired asset must be held on trust for the SMSF.\\r\\n4.The SMSF must have a right to obtain legal ownership of the asset by making one or more installment payments. \\r\\n5.The rights of the lender or any other party involved in the arrangement must be limited to the rights relating to the acquired asset.\\r\\n\\r\\nIf all five requirements are not fully complied with, this could result in the SMSF being disqualified as a regulated super fund which could result in the SMSF becoming liable for tax at the highest margin!\\r\\n\\r\\nHowever, once you have confirmed that all requirements are met, the purchase of real estate through an SMSF takes place in the same way as any real estate purchase: the investor selects the property and their SMSF satisfies the loan requirements as specified by the super-leveraged loan provider. \\r\\n\\r\\nThe SMSF pays the deposit, the balance of the purchase price, any associated legal costs and stamp duty and all costs associated with the property as well. \\r\\n\\r\\nSMSF Purchased Property The Benefits\\r\\n\\r\\nIn return the SMSF receives all proceeds of rent or other income associated with the property. If you hold the property until after you retire and your super goes into the pension phase, you pay no tax on either the capital gains if you sell or the rent if you continue to hold your investment. Before retirement, capital gains and rent earned by your SMSF are taxed at only 15 per cent (if you hold the property for more than a year, this drops to 10 per cent on capital gains). Another benefit of investing in property is that is provides another level of diversification in your portfolio.\\r\\n\\r\\nSMSF Purchased Property The Cons\\r\\nAs with any investment, there are also some possible disadvantages to investing in real estate through your SMSF. For instance, if you borrow to buy property through your super and you re negatively geared, the tax offset only applies to other income earned within the fund not your regular income. Also you cannot live in the property and neither can any of your friends or family members. You can t renovate a property purchased through a SMSF while it is still under a loan.\\r\\nBuying property through a SMSF is generally only suitable for funds with $200,000 in combined funds.\\r\\nBear in mind that this article provides only a very basic overview of how one can use their SMSF to purchase property. Running a SMSF is complicated and penalties for getting things wrong are high.
