Ukrainian railway accident generates huge phosphor cloud

Tuesday, July 17, 2007

An alarm for heavy chemical pollution has been issued in the Lviv region, Ukraine, where yesterday evening a railway disaster led to a fire involving 15 containers of liquid yellow phosphorus.

Extinguishing the fire proved extremely difficult because water cannot be used: in contact with phosphorus, water creates poisonous gas. It took six hours before the flames were extinguished. Gas was generated nonetheless, and at the moment the poisoned area extends about 90 sq. km. The casualties count is already heavy: 20 people are reported injured, 13 of them in critical condition. They have been carried to the Lviv hospital. Podrobnosti reports that the fire started when one of the containers started to leak and the phosphor caught fire.

The poisoned area includes 14 villages. From the five villages that are closer to the disaster area some 800 people have already been evacuated. Half of the evacuees had to manage on their own as there was not enough public transport for all.

At the moment there is no available data about the wind direction or next expected movements of the phosphorus cloud. Special firemen units remain on place to control the possibility of a new fire, while the administration of the Lviv Oblast tries to forecast the possible short- and mid-term evolution of the situation.

The Ukrainian Railways have officially excluded the possibility of a terrorist act as a cause for the disaster.

Podrobnosti reports the deadly dose of yellow phosphor at 0.1 g. According to that source, when poisoning living beings, phosphor causes liver necrosis and attacks the bones and spinal cord.

Nineteen activists killed by Israeli commandos aboard aid convoy bound for Gaza

Monday, May 31, 2010

Notice — August 24, 2015 The title of this article states nineteen were killed, whereas the body more accurately reflects the facts of the time by recording between nine and nineteen deaths. The correct figure at the time was in fact nine deaths.

Between nine and nineteen Free Gaza Movement activists died today in international waters when Israeli Defense Force commandos boarded vessels attempting to break the Israeli blockade of Gaza.

Benjamin Netanyahu gave the death toll to be at least 10. Israeli television says that 19 people were killed and 36 were wounded in the confrontation.

The six vessels, called the Gaza Freedom Flotilla, were carrying 10,000 tonnes of humanitarian aid destined for the Gaza Strip, including water purifiers, prefabricated homes and medical equipment. Passengers include several European members of parliament and MPs from Germany, Belgium, Algeria and Israel.

Israeli Deputy Foreign Minister Danny Ayalon said that “the organizers are well-known for their ties with global jihad, al-Qaida and Hamas. They have a history of arms smuggling and deadly terror.” The Israeli military had declared it would not allow the ships to reach Gaza and said the activists were a “provocation intended to delegitimise Israel”. The Israeli Navy had been transmitting messages throughout the night ordering them to turn back, stating: “If you ignore this order and enter the blockaded area, the Israeli navy will be forced to take all the necessary measures in order to enforce this blockade,” and that the Gaza region was a protected military zone.

Huwaida Arraf, one of the organizers, had said that the flotilla was “fully prepared for the different scenarios” that might arise, and organizers were hopeful that Israeli authorities would “do what’s right” and not stop the convoy. She said, “we fully intend to go to Gaza regardless of any intimidation of threats of violence against us,” and that “they are going to have to forcefully stop us.”

The pre-dawn boarding took place in international waters around 150 kilometres (90 miles) off the coast of Gaza. Footage from on the flotilla’s lead vessel, the MV Mavi Marmara, and video released by the IDF, showed armed Israeli commandos boarding the ship from helicopters and fighting with activists. According to the Israel Defense Forces, the activists attacked the commandos with batons, knives and axes. Israeli Prime Minister Benjamin Netanyahu said;

They were mobbed. They were clubbed, they were beaten, stabbed. There was even a report of gunfire and our soldiers had to defend themselves, defend their lives or they would have been killed.

A spokesman for the flotilla, Greta Berlin accused Israeli troops of indiscriminately shooting at “unarmed civilians”. Israel said troops found weapons aboard the Gaza flotilla which were used against the IDF. The allegations were rejected by both the Free Gaza Movement, IHH and Egypt’s foreign minister, who said the boats had been searched before they left port.

The images are certainly not pleasant. I can only voice regret at all the fatalities

Secretary-General of the United Nations Ban Ki-Moon said he was “shocked by reports of killings and injuries of people on boats carrying supplies for Gaza” and called for “a full investigation to determine exactly how this bloodshed took place” and urged Israel to “urgently provide a full explanation”. Palestinian Authority President Mahmoud Abbas called for three days of mourning to commemorate what he called the “massacre” of protesters. Ismail Haniya, the Hamas leader in Gaza, has dubbed the Israeli action as “a crime”.

Turkey’s prime minister describes Israeli raid as ‘state terrorism’ and said Israel violated international laws. Some of the ships were sailing under Turkish flags and media reports indicate that Turkish nationals are among the dead. Turkey demanded an “urgent explanation” from Israel and warned of “irreparable consequences” after the incident. Netanyahu said the raid was self defense. Turkey is withdrawing its ambassador to Israel and is calling on the U.N. Security Council to convene in an emergency session about Israel.

The European Union’s foreign policy chief, Catherine Ashton, has called on Israeli authorities to launch a “full inquiry” into the killing. She “reiterates the European Union’s position regarding Gaza – the continued policy of closure is unacceptable and politically counterproductive.” Germany’s Foreign Minister Guido Westerwelle said he was “deeply concerned” and France said “nothing can justify” the incident. Sweden, Austria, Greece and Spain have said it was important to “quickly establish” what happened, and have summoned the Israeli ambassadors.

The British Foreign Secretary William Hague has called on the Government of Israel to open all crossings for aid to enter Gaza and said Israel should “address the serious concerns about the deterioration in the humanitarian and economic situation and about the effect on a generation of young Palestinians?.” Russia calls attention to the fact that the Israeli interception of a Gaza-bound international aid flotilla took place in international waters, which it said represents a gross violation of international law.

European Parliament President Jerzy Buzek has urged the international Middle East mediators Russia, the United States, the United Nations and the European Union to persuade Israel to end its blockade of Gaza. Thousands of demonstrators took to the streets in Europe. In Greece and France there was clashes with police. There were protests in cities around the Ireland, UK and Italy. In the Middle East there were protests in Turkey, Lebanon and Iran.

The White House said that the United States “deeply regrets” the loss of life and injuries and was working to understand the circumstances surrounding this “tragedy”. The Organization of the Islamic Conference, comprising of 57 countries, described the flotilla incident as “a serious escalation and a flagrant violation of the international law and human values.”

The media has not been given access to the politicians, activists and journalists who were in the convoy or information about deaths and injuries. Israeli Police spokesman Micky Rosenfeld police say it will deport the roughly 50 of the 671 activists in the flotilla except those who refuse to cooperate. The other activists have been sent to jail in the southern desert town of Beersheba after refusing to identify themselves and will remain in detention.

Irishman Dennis Halliday, a former assistant secretary general of the United Nations and the Northern Irish Nobel Peace Prize laureate, Mairead Corrigan Maguire, are aboard the only boat left in the convoy, the Irish MV Rachel Corrie vessel, named after Rachel Corrie. The vessel is now on the way to the Gaza Strip. The Irish Prime Minister Mr Cowen said he believed Israel’s blockade of humanitarian assistance to Gaza was illegal under international law.

Ruling forbids RadioShack brand in Canada

Friday, March 25, 2005

A U.S. District Court in Tarrant County, Texas, issued a summary judgment Thursday against Circuit City’s InterTAN Inc., requiring all 950 RadioShack stores in Canada to stop using the RadioShack brand in store signs, packaging, products and advertising after June 30.

RadioShack’s Canadian operations were spun off in 1986 to a new corporation, InterTAN Canada, which was purchased in 2004 by RadioShack’s major U.S. competitor, Circuit City. Shortly thereafter, RadioShack sued InterTAN, alleging it had violated the terms of their licensing agreement and seeking the right to terminate the contract early.

In a statement released following the judge’s ruling, RadioShack’s general counsel, Mark Hill, claimed: “The most important thing to us was to protect our brand position in Canada.”

Circuit City chairman and chief executive officer, W. Alan McCollough responded today in a press release seeking an appeal: “We respectfully believe the court has erred in the partial ruling entered yesterday and we will use every means of relief possible to exercise our rights under the agreements, including all appeal rights. The Company believes the positions taken by InterTAN are correct and believe InterTAN will ultimately prevail in the legal proceedings.”

Tips For Donating Your Car To Charity

By Levi Quinn

Donating your used vehicle to charity can be a very generous act. Worthwhile charities benefit greatly from donated vehicles either by using them directly or by selling the vehicle and using the profit for their organization. But if you’ve never donated a vehicle before, than where do you start? Here are some tips to make your donation an easy transaction.

Find the Right Charity

If you aren’t sure which charity to donate your car to then do a little research. However avoid the for-profit intermediary organizations that advertise to handle your car donation. These places tend to keep the majority of the money themselves. Some keep as much as 50 to 90 percent or even more for their pockets. Find a charitable organization that handles the donations themselves so they can keep 100 percent of the profits.

Make sure the charity is eligible to receive tax deductible contributions. Make sure they are a 501(c)(3) organization. Other organizations may claim to be a non-profit but may actually be a 501(c)(4) organization and donations to these types are generally not considered tax deductible. Ask for a copy of the organization’s IRS letter of determination which verifies its tax exempt status.

Value Your Car Correctly

The IRS has cracked down on car donations with the passage of the American Jobs Creation Act of 2004. Under this you can no longer claim fair market value for your donated car worth more than $500 but instead you must claim the amount that the charity sells your vehicle for. There are exceptions to this rule and fair market value determined by either Kelley Blue Book or NADA guide can be used when:

— Instead of selling the vehicle, the charity keeps it and uses it.

— The charity makes improvements to the vehicle before selling it.

— The car is sold at a discounted price to a person with low-income.

— The car is worth less than $500.

Other Tax Considerations

Make sure that you get a receipt from the charity for your car donation. Be aware that non-cash donations are one of the most common triggers to an audit by the IRS, so you’ll want to document the value of the car and keep records of it.

If the car is worth more than $500 you, the donor, must complete Section A of the IRS Form 8283 and attach it to your tax return. You are also required to file with your tax return a written acknowledgement from the charity. If the charity sells the car, the charity must provide you with a certification that the car was sold between unrelated parties and the sale price of the car within 30 days. In this case, your tax deduction will be limited to the total amount the charity sold the car for. If the charity does not sell the car, it must provide you with a receipt within 30 days of the sale. The charity may also be required to provide certification to you stating how it plans to use or improve the car and stating that it promises not to sell or transfer the car. Penalties are imposed on charities that provide fraudulent acknowledgements to donors.

Important Things to Remember

— Formally sign over ownership of the car to the charity. If you fail to do this any thing that happens to the car such as parking tickets or other crimes will be on your shoulders since you will legally still be the owner of the car.

— Take pictures of the car and save receipts for new tires or other upgrades to verify its value.

— Remember, it is the donor, not the charity, who is obligated to value the car and who will pay the penalties if an IRS challenge finds your figure inaccurate.

Bank of America leads Consumer Financial Protection Bureau complaints about mortgages

Thursday, October 3, 2013

A review this week by Wikinews of US Consumer Financial Protection Bureau (CFPB) complaints about mortgages in the United States shows Bank of America leads all lending institutions in complaints.

Since mortgages complaints were recorded in December 2011, 77,622 total have been added to CFPB’s database. 29.2% of these complaints involved Bank of America, with the second most received by Wells Fargo, accounting for 15.5% of all complaints. JPMorgan Chase ranked third by volume of complaints with 9.8%. Ocwen was fourth with 8.7% and Citibank was fifth with 4.8%. Nationstar Mortgage; Green Tree Servicing, LLC; HSBC; PNC Bank; U.S. Bancorp; OneWest Bank; SunTrust Bank; Flagstar Bank; and Select Portfolio Servicing, Inc. each had between 1.0 and 3.8% of total complaints. The remaining 14.4% of all complaints about consumer mortgages were divided between about 530 other lending institutions.

The Motley Fool reported last month that for the past fiscal quarter, the biggest US based mortgage lenders were from first to fifth Wells Fargo, JPMorgan Chase, Bank of America, Quicken Loans and U.S. Bancorp.

According to the US Federal Reserve, debt for family residences stands at US$10.706 trillion for the second quarter of 2013. As of the end of June of this year, Bank of America is the United States’s second largest commercial bank with US$1.343 trillion in domestic assets. Wells Fargo is the fourth largest commercial bank with US$1.251 trillion in domestic assets. JPMorgan Chase is the largest US commercial bank with US$1.329 trillion in domestic assets and US$1.947 trillion in total assets.

The mortgage complaints in the CFPB report include several subproducts. Conventional fixed mortgages account for 27.1% of all complaints. Conventional adjustable mortgages account for 10.0%. FHA mortgages account for 7.7% of all complaints. Home equity loans or lines of credit account for 3.8% of all complaints. VA mortgages are 1.4% of all complaints. Second mortgages and reverse mortgages each account for 0.6% of complaints. The remaining 48.7% of complaints are about other mortgages or other mortgage issues. A few years ago, FHA loans accounted for about 10% of all US mortgages while VA loans accounted for about 3%. Prime loans accounted for over 75% of the market and the rest were subprime mortgages.

California leads all states by volume of complaints with 14768. It is followed by Florida, New York, Georgia and Texas. When complaints are divided by a state’s total population, New Hampshire leads. The state is followed by Washington D.C., Maryland, Georgia and Florida. Complaints do not correlate with national rankings for August’s foreclosure rate by state where Nevada topped the list, followed by Florida, Ohio, Maryland and Delaware.

Two zip codes account for over 1,000 total complaints between them. 565 complaints originated in the 48382 zip code, which is in Commerce Township, Michigan, located in suburban Detroit. 553 complaints originated in the 33071 zip code, in Coral Springs, Florida. According to real estate website Zillow, there are currently 1,033 properties in foreclosure in Coral Springs while Commerce Township only has 131 properties currently in foreclosure. Four other zip codes have 100 plus complaints originating from them. 91730, in Rancho Cucamonga, California, had 158 complaints. 33409, in West Palm Beach, Florida, had 132. 92626, in Costa Mesa, California, had 125 complaints. 92660, in Newport Beach, California, had 122 complaints. Respectively, the towns had 534, 1,068, 153, and 134 properties currently in foreclosure. These numbers are higher than for the cities of a few sampled zip codes where there was only one complaint, such as Gold Hill, Oregon which has 4 properties in foreclosure, and Decatur, Illinois which has 6 properties in foreclosure.

The CFPB categorizes complaints into six categories: “Loan modification, collection, foreclosure” or problems when a person is unable to pay; “Loan servicing, payments, escrow account” or problems with making a payment; “Application, originator, mortgage broker”; “Credit decision / Underwriting”; “Settlement process and costs”, and “Other”. The CFPB says the complaint types indicate consumers “appear to be driven by a desire to seek agreement with their companies on foreclosure alternatives. The complaints indicate that consumer confusion persists around the process and requirements for obtaining loan modifications and refinancing, especially regarding document submission timeframes, payment trial periods, allocation of payments, treatment of income in eligibility calculations, and credit bureau reporting during the evaluation period.” Currently, 59.6% of all complaints against lenders deal with being unable to pay. 25.1% deal with problems in making a payment. 7.0% have to do with the application process.

Of the complaint-heavy zip codes, for 48382 in Commerce Township, Michigan, 98.9% of all complaints have to deal with being unable to pay. Accounting for 23.4% of all mortgage complaints in Commerce Township, 132 of the complaints for being unable to pay were made regarding Bank of America, accounting for 97.8% or all but 3 complaints against them from the zip. 121 of the Bank of America responses in Commerce Township were closed with explanation and 12 were closed with non-monetary relief. 33071 in Coral Springs is different, with 537 of the 553 complaints being categorized under other. Only 11 complaints relate to foreclosure and issues with being able to pay. 92626 in Costa Mesa, where 32% of the mortgage complaints were about Bank of America and 26.4% were about Wells Fargo, had 93.6% of its complaints dealing with being unable to pay. 5 total complaints dealt with payment issues and 3 dealt with applications.

Beyond regional variance in complaint types lodged, the top five mortgage lenders by volume of complaints all had being unable to pay as their top complaint category, ranging between 55.8% for Citibank and 69.4% for Bank of America. Problems with payment accounted for the second largest area of complaints, with Ocwen having the largest percentage of complaints at 31.9% and Bank of America having the smallest at 18.8%. Foreclosure was the top area of complaints for a number of other lending institutions including 1st Alliance Lending, OneWest Bank, Ally Bank, Banco Popular de Puerto Rico, Bank of the West, BMO Harris, BOK Financial Corp, Caliber Home Loans, Inc, Capital One, Deutsche Bank and EverBank.

Nationally, complaints reached a high of 5,840 for January 2013, 1,107 more than the next highest month of April 2013. The total emerging for September is the second lowest since records were first kept in December 2011. On a state by state level, this pattern largely repeats with a major exception for Florida which saw a peak of 849 complaints in June 2012. Then, as now, Florida was one of the top five states in the nation in its foreclosure rate. The national January spike came as the Qualified Mortgage standard required by the The Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010 came into play. It required mortgage lenders to take steps to insure borrowers could repay their mortgages.

Bank of America’s complaint volume follows the national trend, with a spike in January 2013 with 1,925 total complaints. Unlike nationally, the next month by volume of complaints was February of this year with 1,598 complaints. Prior to that, the highest month was May 2012 with 1,418 complaints. The lowest volume of complaints is September this year with 334.

Wells Fargo matched national trends for volume of complaints by month, with the exception of the current month being the lowest on record for number of complaints with 197 compared to the next lowest month, December 2011, when they had 221. JPMorgan’s complaint volume by month spiked in January and March of this year with 504 complaints. April of this year was the next highest month with 493 complaints, edging out May of last year with 488 complaints. September this year is on track to be the lowest month by complaint volume.

The federal government shutdown is unlikely to impact the current mortgage situation in the United States directly for most consumers, though mortgage processing by the Federal Housing Administration could be slower, resulting in fewer mortgages processed.

11-year-old California girl charged for throwing stone in defense

Monday, July 18, 2005

An 11-year-old girl faces serious assault charges in California after casting a stone at a group of boys who were throwing water balloons at her. In April, Maribel Cuevas was apprehended by Fresno, California police and spent five days in a detention center after throwing the object at the group of boys who bombarded her with water balloons as she walked down the sidewalk. A 9-year-old boy was hit with the stone, and suffered a wound to his head requiring medical assistance.

Since then, Cuevas has spent one month under house arrest pending court. Cuevas’ lawyer, Richard Beshwate, told the BBC that “They [Fresno police] are treating her like a violent parole offender. It’s not a felony, it’s an 11-year-old acting like an 11-year-old.”

Fresno Police Sergeant Anthony Martinez told reporters: “We responded. We determined a felony assault had taken place and the officers took the actions that were necessary.” Cuevas is due back in court next month on felony assault charges.

The girl was placed in juvenile hall during her five-day detention, with only one 30-minute visit from her parents. She was then placed under a 30 day house arrest and required to wear an electronic monitoring bracelet. The house arrest allowed the girl to attend school.

Maribel, who knows very little English, said that the boy initiated the conflict — the boy also admitted as much.

How Much Compensation For A Knee Injury?

By Carolyn Clayton

Have you had an accident playing football damaged your knee? Maybe you were in a car accident and your knee was damages? Would you like to know what compensation you might be entitled too?

Well for a start damage to the knee can be quite serious, we all need our knees functioning properly to be able to walk and go about our daily routine. Depending on the extent of your injury will depend on how much compensation you will get. The amount of compensation for any knee injuries falls between a few hundred pounds for a simple twist to up to 50,000 for more serious injuries.

The amount of compensation you could receive from a serious knee injury where the injured had lengthy treatment, a considerable amount of pain and loss of function, arthrodesis or arthroplasty has taken place or is inevitable the amount would be in the region of 40,750 to 56,000.

For a less fracture extending into the knee joint causing constant pain, limiting movement, loss of agility with the possibility of osteoarthritis the amount of compensation you might receive would be in the region of 30,500 to 40,750.

A less severe knee injury resulting in less severe disability where there is still continuing symptoms of pain and limitation of movement could result in a award of 15,500 to 25,000.

Moderate knee injuries involving dislocation, torn cartilage or meniscus which might accelerate symptoms from a pre-existing condition which result in minor instability, weakness or other mild future disability the amount you could receive in compensation would be in the region of 8,400 to 15,500.

Less serious moderate knee injuries where there maybe some pain and discomfort, the amount of compensation would be in the region of 8,150. Where there has been complete recovery the award is unlikely to exceed 3,500.

These amounts are from the judicial studies board as of 2006. For more accurate information about your injury and how to go about making a claim you will need to find a competent accident solicitor. Companies that specialises in offering free impartial advice that can explain the no win no fee agreement in simple terms are the ones to go for. There are so many no win no fee accident solicitors in the UK and they are all competing for your cases. Unfortunately it can be big business for solicitors as they demand huge fees. The best solicitors are the ones that put you and your needs first.

You may have heard of the term no win no fee. It is often used and rarely understood. It basically means that the solicitor is working for free until the case is won. When the case is one your solicitor will claim its own expenses back from the person who was responsible. If the negligence was on the part of your employer then your employer should have insurance to cover this. There maybe a chance that you may loose you case in which case you will be offered insurance to protect you from the costs also. Generally a good solicitor will only take on a case they believe they can win.

Remember claiming compensation for accidents is your legal and civil right. If the accident was not your fault and you have suffered because of the injury then you have every right to pursue a claim and you should.
