Former US Representative John Conyers dies at age 90

Yesterday, former United States Representative John Conyers died in his sleep, according to a family spokesperson. Conyers, the former Democratic Dean of the House of Representatives, was 90.

John James Conyers Jr., first elected to Congress in 1964, was born in Detroit, Michigan, in 1929. After serving in the Korean War, he attended Wayne State University, receiving both a bachelor’s degree and a law degree. He worked for three years for Representative John Dingell as an aide.

Conyers ran for Congress in 1964, winning by a margin of 108 votes. He took office 1965, and spent the next five decades in Congress. He spent his time in the House promoting civil rights legislation, and from 1965 Rosa Parks worked for his Detroit office for 23 years, till her retirement. Starting in 1968, he spent 15 years fighting for Martin Luther King Jr. Day to be a federal holiday; President Ronald Reagan signed Conyers’s bill into law in 1983.

In 1971, Conyers co-founded the Congressional Black Caucus. He served as a member of the House Oversight Committee until 1995, then joined the House Judiciary Committee. He served as the chair of the Judiciary Committee while the Democratic party controlled the House from 2007 until 2011, and remained a member of the committee until he retired in 2017. According to Associated Press, Conyers was unique on the Judiciary Committee in having participated in the impeachment hearings of two different Presidents, Richard Nixon, in 1972, and Bill Clinton, in 1998.

In 2017, after sexual misconduct allegations came to light, Conyers resigned, referencing health issues. At the time, he had served in Congress longer than any other then-current member, earning him the distinction of Dean of the House of Representatives. NPR reported he had also served in Congress longer than any other African American, current or past.

M5 motorway closed after shots fired at police car

Part of the M5 in England, United Kingdom has been closed after shots were fired at a police car in the early hours of this morning.

A blue, L-registered BMW 3 Series car was parked in a lay-by just off the motorway on the B4008 near Junction 12. As the police car approached the vehicle it drove off and at least two shots were fired at the police car from the back of the BMW.

Kate Nelmes from Gloucestershire Police said, “As the vehicle drove onto the carriageway, someone believed to be in the back of the vehicle then fired two shots in the direction of the police vehicle.”

The motorway between Junction 12 and 13 was closed causing major traffic problems however since then the northbound carriageway has been reopened. The southbound carriageway is expected to be open around 13:00 BST.

Mayor declares weather emergency in New York City

On Tuesday, Mayor Michael R. Bloomberg announced a weather emergency in New York City, New York. The announcement was issued as a preemptive measure in preparation for an expected 6-12 inches of snow Wednesday, although the Metropolitan Transportation Authority claims to be ready for 14 inches.

Bloomberg explained the meaning of the preemptive announcement by stating: “We recognize that we did not do the job that New Yorkers rightly expect of us in the last storm. We intend to make sure that does not happen again.” Despite declaring an emergency, the mayor said the city would not make the decision to close public schools until 5 AM.

The city is looking for people to shovel snow off sidewalks and intersections. The New York City Housing Authority announced on their Twitter page, “Turn a snow day into a payday. The city is looking for snow removal help. Apply now.” The linked page offered $12 an hour to shovel snow for the city.

Flash floods kill over a hundred in India, 500 missing

Five hundred people are missing and as many as 150 are reported to have been killed by flash floods in India, caused by a sudden cloudburst that hit Indian-controlled Kashmir on Friday. The downpour struck the town of Leh and several surrounding villages, and reportedly caused a mud slide that hit the refugee-populated village of Choglamsar.

Associated Press reported that at least five foreign tourists were among those killed. Their nationalities are not known but New Delhi Television (NDTV) reported that 110 tourists, half of them foreigners, were being looked after at an Army transit camp on the Leh-Manali road. NDTV also said that the tourists had been given food, medicine and phone connections to their embassies. Flights have been arranged by the Indian government to bring affected foreign tourists back home.

Massive relief efforts are continuing; Farooq Ahmad, who is Inspector General of Police in Kashmir reported on Sunday today that “63 bodies had been identified so far and that rescue teams were fanning out to six villages near Leh that had not yet been reached during relief operations.” Believed to contain 5000 people, Choglamsar, on Leh’s outskirts, is one of the villages that rescuers have been clearing roads to reach.

The army has been called in to assist in rescue work. Thousands of troops, police and paramilitary soldiers were clearing roads in order to reach isolated villages. Those living in the upper reaches, whose housing was not adequate to provide protection, will have borne the full impact of the mud slides caused by the 12 mm of rain that fell on Friday in just a few minutes.

Officials said that rescuers were digging through crushed homes and piles of mud to search for survivors. The hundreds of reported injured are being treated at an army hospital and several makeshift clinics. Mohammed Deen Khan, a social activist who has been assisting in rescue work, said the mud was 15 feet high in some places. Heavy earth-moving equipment has been brought in to move the tonnes of mud and boulders blocking roads.

The rescue officials have faced a serious problem due to the severe damage of the Bharat Sanchar Nigam Limited (BSNL) office, a telecommunication enterprise, leading to the complete disruption of communication in the Leh region. The general manager of BSNL reports that the damage has caused a loss of 120 million INR. Another telecommunication enterprise, Airtel, has provided SIM cards to local administration for setting up hotlines that people can call for assistance.

The major problem is due to the communication breakdown. If communication is restored it will help in co-ordination of rescue operations in a better way.

Pashi Tsetan, a local administration development wing (deputy director) said, “The major problem is due to the communication breakdown. 1,314 people, mostly tourists, have been airlifted from Leh to Delhi. Three additional Indian Airlines flights from Jammu and Delhi have been planned. Three IL-76 and four AN-32 aircraft carried relief material to Leh this morning, and four more by Jet Airways and Air India and three by Kingfisher Airlines will carry relief material and doctors to Leh.

The ITBP has sent water tankers containing drinking water to affected areas. Medical camps have been set up in villages like Saboo. The bodies of eleven persons were transported to Jammu and Kashmir, Punjab, and Rajasthan this morning.

India’s crisis comes as Pakistan is experiencing the worst floods in the country’s history.

England fans watch match in cinema

London — A few hundred England fans weren’t watching the 2006 FIFA World Cup match against Sweden last night in a pub or at home, but instead had ventured out to their local cinema to see the game on the big screen. A number of Odeon cinemas nationwide have been using digital projection technology to screen the matches live with a high definition (HD) picture. HD broadcasts contain a greater level of detail than traditional TV broadcasts, meaning a sharper picture and better sound quality.

In the darkened auditorium of the cinema in Covent Garden, the audience (or should that be crowd?) were behaving almost as if they were at the stadium, singing along to the national anthem, cheering at the England goals and groaning at the Sweden chances. At times, chants being sung by the England crowd at the match were even picked up and sung along to by those watching the cinema screen like some kind of football karaoke contest.

Trailers before the match were replaced by a soundtrack of England anthems, both the successful and not-so-successful ones, and the traditional movie treat of popcorn was replaced by trays of beer (in plastic cups) being brought in by the punters. The cinema had cheekily listed the screening as being ‘directed by Sven-Göran Eriksson’ and as ‘starring Wayne Rooney (hopefully)’.

Despite a disappointing 2-2 draw, the audience seemed impressed with the experience. “I’m a bit short and so wanted to make sure I had good view without having to jostle around for position,” Amanda, from London, explained to me. “I also liked that it was non-smoking, and there was a fabulous atmosphere”. Sian, Caio and Laura, who lived locally, said they wanted to see the match on the big screen and commented on the excellent picture quality.

Other events that have been broadcast by the cinema chain include concerts by Robbie Williams and Elton John. Odeon Marketing Director Luke Vetere said “offering films is just one part of the cinema experience – our ambition is to offer guests the chance to watch other events they feel passionate about”. Watching football in the cinema is not a brand new event though, during previous World Cups such as in 1966, film footage from the matches was broadcast in cinemas after the event, providing a way for people to see the games in colour when TV broadcasts were in black and white.

Cinema screenings aren’t the only way that fans can watch the World Cup games in high-definition this year though, as both Sky TV and Telewest have been broadcasting the games in HD to viewers with a special set-top box. There have been trials with HD on the growing Freeview platform too, with a pilot group of a few hundred viewers in London. However, as any move to roll out HD on Freeview would use up extra space on the broadcast spectrum and would require viewers to buy a new set-top box, it seems unlikely that this will happen any time soon.

There are times when living in Scotland, rather than England, has its disadvantages. The weather, for a start. And for those of us who live in the central belt, STV’s continual failure to get any of the good programmes being shown everywhere else. But when house buyers come to see a solicitor in Scotland, a question they often ask is “What if I’m gazumped?” Then we can proudly say: don’t worry. It’s unlikely to happen in Scotland.

Scottish clients have often seen article after article in the press complaining about this English practice of gazumping, whereby the owner of a house accepts an offer to buy his property “subject to contract”. Nothing is binding until contracts are signed (or “exchanged”) between the buyer and seller. It can take as long as 10 – 12 weeks for these formalities to be completed, and if the seller is tempted by a higher offer during this period he simply cancels the deal, leaving the buyer not just disappointed but also out-of-pocket, as he will probably have paid out fees to his solicitor and surveyor.

When property prices are in decline, as they are now, the practice of gazumping becomes rare. The buyer’s revenge of “Gazundering” then becomes a problem, as buyers can wait until everybody is poised to exchange contracts before lowering the offer on the property, threatening the collapse of a whole chain of house sales waiting for the deal to go through. But, as sellers will be glad to hear, gazundering is unlikely to happen in Scotland either.

In Scotland, once you have found the house you like, you instruct your solicitor to note your interest. If a number of buyers are interested, there is usually a process of sealed bids in which each prospective buyer puts in a blind offer of a certain price by a closing date, and when the bids are opened, the highest one wins. A series of letters known as missives are then exchanged ironing out the deal, and the matter is then binding on both sides, at a much earlier stage than in England. Most of Scotland, and in particular Edinburgh and Glasgow, have “Standard Missives” which means that the contract or missive requires a minimum of negotiation and allows contracts to be exchanged without delay. There is no second stage of “exchange of contracts.”

Of course, it is always possible that one party may back out before missives are finished. However, conclusion of missives tends to take place quite quickly, and before either side has incurred much expense, so if this happens it is not usually serious.

Scottish clients interested in buying properties in England may like to know that changes are being considered for England, and draughtsmen are working on a new style of contract that will deter buyers and sellers from backing out of the deal, providing a lock-out agreement that would, among other things, stop gazumping and gazundering. But it would be voluntary, not a requirement for the buyer and seller to sign up.

This contract would require both parties to continue with the house sale at the agreed price subject to certain conditions: if, for example, the property were found to be suffering subsidence, the contract would be nullified. But if the market suddenly dropped and the buyer wanted to reduce the price, the contract would hold firm and the buyer would either have to continue with the deal at the agreed price, or lose a deposit for withdrawing from the deal. The size of the deposit would vary from contract to contract, but would always be big enough to stop people from dropping out without good reason.

All this is in the future. For now, gazumping and gazundering will continue to be a problem in England. But, let’s not be unfair to the English. Though the press loves to talk about it, the practices are not as common as you might think. We know of cases where a seller received higher offers but stuck to the original one because he felt it was the honourable thing to do. Also, gazumping has sometimes saved the day. In cases where the original buyer has started to prove difficult or is wasting everybody’s time, endangering the whole chain of sales and purchases, he can be quickly ditched, a new buyer can step in and the whole chain can be completed.

However, it’s still good to know that in Scotland, once your offer is accepted, the deal is binding and enforceable on both sides, and neither side is going to back out of it later just because they could do better on the price.

Glasgow cannabis enthusiasts celebrate ‘green’ on city green

Coinciding with Easter Sunday, Glasgow Cannabis Social Club’s annual 420 event was held on Glasgow Green, under sunny blue skies, and overlooking the river Clyde. Despite the city’s council attempting to revoke permission for the gathering at the last minute, police were happy for it to go-ahead with approximately a dozen officers attending in high-visibility vests.

The Daily Record reported five arrests were made for minor offences, likely smoking and possession of small quantities of cannabis. Taking a less-sensational — and more accurate — line of reporting, the Monday edition of Glasgow’s Evening News stated five were referred to the Procurator Fiscal who is responsible for deciding if charges should be brought.

Official figures provided by the police were that 150 attended. With people coming and going, Wikinews reporters estimated upwards of 200 attended, compared to nearly 700 who had signed up for the event on Facebook. Hemp goods were advertised and on sale at the event, and some attendees were seen drinking cannabis-themed energy drinks.

“I was searched and charged under the Misuse of Drugs Act (which is a lot of bollocks)” one attendee noted online, adding “not fair to happen on a brilliant day like it was, other than that I had a great day!” A second said they were openly smoking and ignored by police, who “were only really focusing on people who looked particularly young”.

Cannabis seeds were openly and legally sold at the event and a hydroponics supplier brought a motortrike towing an advertising trailer. Actually growing cannabis is, however, illegal in the UK.

With the event openly advocating the legalisation of cannabis, speakers put their arguments for this to a receptive crowd. Retired police officer James Duffy, of Law Enforcement Against Prohibition, spoke of the failed United States alcohol prohibition policy; stressing such policies needlessly bring people into contact with criminal elements. Highlighting other countries where legalisation has been implemented, he pointed out such led to lower crime, and lower drug use overall.

One speaker, who produced a bottle of cannabis oil he had received through the post, asserted this cured his prostate cancer. Others highlighted the current use of Sativex by the National Health Service, with a cost in-excess of £150 for a single bottle of GW Pharmaceuticals patented spray — as-compared to the oil shown to the crowd, with a manufacturing cost of approximately £10.
