Officials of the Fanmi Lavalas party in Haiti threatened boycott of the upcoming general elections if one of their party leaders, Father Gerard Jean-Juste, is not released from jail. Jean-Juste is being jailed, arrested a month ago on July 21, in relation to the murder of journalist. The Fanmi Lavalas party is currently divided among moderate factions and those with closer ties to former President Aristide.

Jean-Juste is believed to be a favorite presidential candidate for the party. A representative of the party, Gerald Gilles, commented saying, “after several consultations, the masses that we represent and the base of the party claim Father Jean-Juste as their presidential candidate. So he will be our candidate,” and “we say loud and clear (that) we’ll boycott the elections if Jean-Juste, and many other political prisoners that are potential candidates for our party, are not released.”

HIV-positive man receives 35 years for spitting on Dallas police officer

An HIV-positive man was sentenced to 35 years in prison Wednesday, one day after being convicted of harassment of a public servant for spitting into the eye and open mouth of a Dallas, Texas police officer in May 2006. The United States Centers for Disease Control and Prevention says that no one has ever contracted HIV from saliva, and a gay-rights and AIDS advocacy group called the sentence excessive.

A Dallas County jury concluded that Willie Campbell’s act of spitting on policeman Dan Waller in 2006 constituted the use of his saliva as a deadly weapon. The incident occurred while Campbell, 42, was resisting arrest while being taken into custody for public intoxication.

“He turns and spits. He hits me in the eye and mouth. Then he told me he has AIDS. I immediately began looking for something to flush my eyes with,” said Waller to The Dallas Morning News.

Officer Waller responded after a bystander reported seeing an unconscious male lying outside a building. Dallas County prosecutors stated that Campbell attempted to fight paramedics and kicked the police officer who arrested him for public intoxication.

It’s been 25 years since the virus was identified, but there are still lots of fears.

Prosecutors said that Campbell yelled that he was innocent during the trial, and claimed a police officer was lying. Campbell’s lawyer Russell Heinrichs said that because he had a history of convictions including similarly attacking two other police officers, biting inmates, and other offenses, he was indicted under a habitual offender statute. The statute increased his minimum sentence to 25 years in prison. Because the jury ruled that Campbell’s saliva was used as a deadly weapon, he will not be eligible for parole until completing at least half his sentence.

If you look at the facts of this case, it was clear that the defendant intended to cause serious bodily injury.

The organization Lambda Legal (Lambda Legal Defense and Education Fund), which advocates for individuals living with HIV, says that saliva should not be considered a deadly weapon. Bebe Anderson, the HIV projects director at Lambda Legal, spoke with The Dallas Morning News about the sentence. “It’s been 25 years since the virus was identified, but there are still lots of fears,” said Anderson.

The Dallas County prosecutor who handled the trial, Jenni Morse, said that the deadly weapon finding was justified. “No matter how minuscule, there is some risk. That means there is the possibility of causing serious bodily injury or death,” said Morse. Dallas County District Attorney Craig Watkins stated: “If you look at the facts of this case, it was clear that the defendant intended to cause serious bodily injury.”

Contact with saliva, tears, or sweat has never been shown to result in transmission of HIV.

A page at the CDC’s website, HIV and Its Transmission, states: “HIV has been found in saliva and tears in very low quantities from some AIDS patients.” The subsection “Saliva, Tears, and Sweat” concludes that: “Contact with saliva, tears, or sweat has never been shown to result in transmission of HIV.” On Friday the Dallas County Health Department released a statement explaining that HIV is most commonly spread through sexual contact, sharing needles, or transfusion from an infected blood product.

THE Tembari Children’s Care (TCC) Inc is a day care facility at ATS Oro Settlement, 7-Mile, outside of Port Moresby, PNG. To date, it takes care of more than 200 former street children – orphans, abandoned and the unfortunate – by serving them meals twice a day, and providing them early education. Assistance – food and money – is sent by supporters who find merit in the services we provide to these children. At The Center, they are family. For all of these, we need support that is sustainable.

The seeds of TCC first were planted in 2003 when Rishabh Bhandari, then a middle-school student at Murray International in Port Moresby, heard two NGO workers, Penny and Hayward, speak about the plight of so many children in Port Moresby. Initially TCC was an informal organization that raised money for the most unfortunate and vulnerable children in Port Moresby; typically these children were orphans or abandoned. As their fundraising efforts and passion for the children grew, Rishabh, Penny, and Hayward were able to recruit other volunteers to join their efforts as a result TCC began serving more and more children with better quality and with increasing frequency. In May 2008, the Tembari Children s Care In. was formally incorporated essentially meaning the formation of TCC as its own legal and formalized entity.

Now termed an active local community-based organization (CBO), TCC is based in Port Moresby. The organization was formed to improve the living standards of vulnerable children, and to facilitate this goal we aspire to establish and maintain community learning centers (CLCs) in the more rural outskirts of Port Moresby. These CLCs can teach community leaders about education and awareness programs that will foster the development and welfare of the community s orphans.

It is also the vision of TCC to seek and procure external assistance and resources from donors, governments, and individuals to support the program and the children it seeks to help.

Our Achievements – we have come a long way and still have a long way to go

We are very proud of what we have achieved since we opened in 2003. There are 183 children associated with the TCC as of when this page was written, and the number is growing! 83 children are attending local schools, where we pay for their school fees, and 100 pre-schoolers are having regular lessons forming the crucial foundation for their future education. 5 pre-schoolers have graduated from our pre-school and are now in grades 5 and 6.

We are also well on our way in completing our latest project: a 60 sq. metre building that will act as a multi-purpose hall/classroom. The project will cost K50,000 (US $22,500) and will be our major fundraising focus for 2012.

We have also taken steps to create a clean and hygienic environment for the children at TCC by building a toilet and installing water tanks for a clean and reliable water supply. We have also arranged for the centre to receive regular electricity. These amenities, considered rudimentary in much of the developed world, are necessary for every human to live an empowered and dignified life.

Our Sustainability Project has also been a success. By financing people from local communities to undertake different vocations, we are helping empower them to become community leaders, take care of their family s needs, contribute a small portion of their income to the TCC children, as well as impart vocational training and expertise to some of the older TCC children.

Yet despite all we have done so far, there is much need for continuity and further expansion of our projects in order to help even more children in Papua New Guinea

Improving Childrens lives and education.

At Tembari Children Care, we aim to offer the best possible care for our 183 children. This includes basic necessities such as shelter, 2 meals a day, health care, education, and a sense of belonging. With these objectives, we particularly emphasize the need for each child to receive the best possible education.

We have had recent success with the start of our Saturday tutoring program.

The centre focuses its efforts on education, partly because sophisticated pedagogy is a major step in helping people become good and productive members of a society.

To better our children s education, we currently have 83 children attending schools with the fees being paid by the orphanage. There are also 100 pre-school children who receive classes in our 2 make-shift classrooms. Our 3rd classroom is currently sheltered by a mango tree clearly not a tenable solution when it rains. We are striving to build a 60m2 multi-purpose hall which will double as a classroom. The hall will cost approximately K50,000 (US $22,500

Copyright on musical recordings extended by twenty years in EU

The Council of the European Union voted yesterday to extend the term of copyright on sound recordings by twenty years, from 50 years to 70, preventing a number of early recordings of 1960s rock musicians including The Beatles from entering the public domain. The 1962 hit “Love Me Do” would have entered the public domain in 2012 if this legislation had not been introduced. EU member states have to enact the copyright extension within two years.

The news was welcomed by representatives of the recording industry and by some recording artists. Cliff Richard has campaigned for term extension. Mick Jagger from the Rolling Stones said the decision was “obviously advantageous” to performers, and Bjorn Ulvaeus from Abba welcomed the continued control over the group’s recordings: “Now I won’t have to see Abba being used in a TV commercial”. Geoff Taylor from the British Phonographic Industry said “[a]n exceptional period of British musical genius was about to lose its protection. As a matter of principle, it is right that our musicians should benefit from their creativity during their lifetimes, and that they should not be disadvantaged compared to musicians in other countries.”

Extension of the copyright term also has critics. Jim Killock, from the British digital rights advocacy group the Open Rights Group (ORG), said the move “puts money into the pockets of big labels” but will be “unlikely to benefit smaller artists and it will mean that a lot of sound recordings that are out of print will stay out of print”. Singer Sandie Shaw, of the Featured Artists’ Coalition, said the move would be “extremely good news for record companies and collection agencies, but bad news for artists” and would lead to artists having “20 more years in servitude to contracts that are no longer appropriate to a digital age”.

The extension to 70 years is less than that EU Commissioner Charlie McCreevy proposed in 2008. At that time, Wikinews interviewed Eddan Katz of the Electronic Frontier Foundation (EFF) and Becky Hogge, then Executive Director of ORG, in Brussels. The two organisations were gathering like-minded groups to oppose harmonisation with the US’s 95-year term. Characterising the sought extension as “Cliff Richard’s pension”, Hogge asserted, “[w]hat you’ve got at the end of the day with copyright term extension is basically […] rent seeking by special interest groups lobbying governments to change the law in order that they may economically gain directly.”

Two reviews of intellectual property rights in Britain have concluded it would not be economically beneficial to extend copyright terms on sound recordings. The Gowers Review of Intellectual Property in 2006 concluded extension of the copyright term would “negatively impact upon consumers and industry”. The Hargreaves Review of Intellectual Property and Growth in 2011 concluded it would be “economically detrimental”. A study conducted by Bournemouth University’s Center for Intellectual Property Policy and Management concluded 72% of the economic benefits of the term extension would go to record labels, with 28% going to artists, only 4% of which are going to less successful artists.
